Finally after numerous logins at USCIS, I saw today..Request for additional Evidence sent
on my I140..I only happen to see when some other guy with Eb3 Pd2005 and Rd of August 15 got his I 140approval...
so I logged in to see ..I too have LUD
I wonder what it may be because I had sent all my W2s since my PD of 2001..
My friend from my company had also received RFE for TAX papers last year. She sent it and was approved..
Hopefully I am too..because I never changed jobs working for the last 8 years....and had prior necessary experience before joining my current job...plus 1 year in current job

All,
I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)
Do I need to worry about this? any advice/suggetion?

Whn I entered US after visiting home country Nov 06, they gave me an I 94 till Dec 06 which was the end term of my first H1 B term.
i got the approval for xtension. In approval notice at the bottom, i see a new I 94 till 2009.
so now i got 2 I-94's now.
cud any body tell which is the real one.
next time whn i go out of this country, which i-94 i shud i hand it over to the officials??

For 2011 EB2 without spillover
China: August'2006 and India: May'2006
Monthly ~250 allocation is not good enough to cover pending cases prior to May 2006. prior to May'2006 no.of pending cases are close to 2700 cases, so this year quota is good enough to clear these pending cases. With porting we may also see Unavailable down the time.
This leaves for 2006 pending cases
China - 2950
India - 11800 . total ~15K
If we get spill over of 14K then EB2 India & China will move to 2007. Do we get 14K spillover for current year is Big ?

October 2008 to September 2009
Certified cases: India- 6403 and China - 1090
Certified-Expired: India-4984 and China-1022
Spill Over Analysis:
for this we need to consider EB1, Eb2 and Eb5 Quota which is 90K+
EB1 Pending at the beging ofthe year: 7595
Eb2 Row Pending: 8859

Eb2 India & China Quota will be utilized fully : 5600
Total 22,077 so 90K-22K = 68K available for 2011 for categories. EB1, EB5 & ROW EB2
Spill Over Estimate is 68K - EB1, EB5 & Row EB2 estimate. this estimate is diff task & Key.

I am a physician with subspeciality board certification. I have been in AOS/EAD since July 2008 as a dependent on my wifes EB3 Employment based petition.
Due to current retrogression, I want to explore the EB1 route. The question I have is can I apply for a new EB1/AOS in view of my current status of being in AOS/EAD already.
What impact will it have on my wife if I choose to add her as dependent.

You dont have to apply for a COS as long as she is leaving US before her current I-94 expires. However, note that when she goes for her H4 interview, she might be asked to prove her H1 status by showing her employment details (recent pay checks, tax documents..) in addition to your employment documents before they give her the H4 Visa...This happened with one of my friends at Chennai embassy...Just wanted to give you a heads up on that....

The American Competitiveness and Workforce Improvement Act (ACWIA), imposes annual reporting requirements on U.S. Citizenship and Immigration Services (USCIS) concerning the countries of origin and occupations of, educational levels attained by, and compensation paid to, aliens who were issued visas or otherwise provided nonimmigrant status under H1B Visas (http://www.h1b.biz/lawyer-attorney-1137085.html) during the previous fiscal year.
Here are some highlights from the report submitted by USCIS earlier this year:

Hi,
I am on H1, Applied EAD and Travelling on AP.
Is there a problem if I don't have approved EAD while I come back?
Please note EAD has nothing to do with travel.
EAD is authorization to work while adjusting your status.
AP is advance paroled document which you require when AOS is pending, you will be admitted in as parolee.

These groups were able to muscle passage of a legislative bill in the Senate yesterday recapturing 61,000 unused EB-3 foreign worker visa numbers for them. This bill was passed as part of the Labor-HHS 2008 appropriation bill. Reportedly, this bill faces two roadblocks ahead to make it into a final legislation. One is the White House that has been threatening to veto the Labor-HHS bill in toto because of the amount of spending. Second is the House that has to agree to the Senate version in the conference committee. However, the second roadblock does not seem to pose any serious threat as demonstrated by the move of some of Democrats in the House. Please stay tuned.
