My situation is very unusual. I got a notification that the case is here.
On March 26, 2008, we transferred this case to our SALT LAKE CITY, UT location to conduct the interview that is a standard part of processing
Another notification on 04/15/08 is The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office.
I went to SLC immigration office yesterday and the officer told me they dont have my case and it is in national benefit center and thats all. He didnt tell anything more. Then, I call the general line and was transferred to the national benefit center. They told me that the case came back from Salt Lake on 04/15 and I will know a decision in about 60 days which is very generic message. Then, I asked what happened to the interview, he said the application was reviewed and came back with the reviewer note. He didnt say much why no interview was conducted. He said someone else in the National Benefit Center will review the case to make a decision.
Now, I am very confused on what is going on. I read a lot of posting in different immigration forum last night. It seems very unusual to me. I couldnt find any case came to local office and then went back to NBC without an interview.
I hope someone can tell me what is going on.

I filed I-485 for me and my wife in Aug'07. I have plan to join client and would like to change the lawyer since he is a company lawyer or represent myself for my wife and my I485. If I need to self represent what are the steps? Do I have to file G28 by selecting the option other for my and send covering letter? Will it trigger any RFE? Please advice me.

What I don't understand is why you are filing another I-140 when you already filed I-485? In any case you can use AC21 only after your 485 has been pending for more than 180 days.
Employer A with EB3 PD Feb2003 and I 485 filed
Same Employer A is doing EB2 PERM with I 140 PD porting
Is it possible to invoke AC21 in middle of process??
1. is it possible to use AC21 after 140 approval??, any time constraints?
2. what about between 140 filing and 140 approval?
3. at what stage it is not safe?
any advice please

tom friedman doesn't know about the details of this issue..... for him immigration means more h1b visa..... he doesn't have a clue @ gc mess...... there r others who have done research on this subject.... but those studies did not get as much attention.... maybe others need to come up with a shape... lets pick one.... lets say "earth is rhombus".... and then publish these reports... that might help catch some attention....

"THE CHILDREN OF H-1B VISA HOLDERS
At the 2004 Intel Science Talent Search, the nation’s premiere science competition for top high school students, the National Foundation for American Policy conducted interviews to determine the immigration background of the 40 finalists. The results: two-thirds of the Intel Science Talent Search finalists were the children of immigrants. And even though new H-1B visa holders each year represent only 0.03 percent of the U.S. population, it turns out more of the children had parents who entered the country on H-1B visas than had parents born in the United States. In other words, if critics had their way, many of the coming generation’s top scientists and engineers would not be here in the United States today – because we never would have allowed in their parents."

Hello Folks
I am in NJ and my current H1b expires on Nov 2008. My DL expires on Set 2008 . I was under impression that I need atleast 6 months or more valid visa to get licence.
Company didnot agree to file premium process for H1b. They are saying I have plenty of time and they will apply in Aug . I and we know that now a days it takes more than 3-4 months to get visa.
Is there a way I can get temporary lic in Nj. lawer was saying I can request 3 month temp lic beased on Notice received from CIS. Is that true ? does any one gone through same in NJ ?
thanks
My understanding is that NJ adds 3 months to your visa expiry date for DL. You should get a DL valid till Feb 2009. I am not sure about 6 months validity rule. Check their web site.

Hi, Sorry if this has been asked already.. I am on H1B and the primary applicant... Can I change my SSN to remove "Work with Authorization only" statement on SSN by using EAD?
I am planning to stay on H1B and I dont want to invalidate H1B by doing this.
Thanks in advance!

You are looking at a old document. The I-94 copies were asked back in 2008 to identify that you are in fact at or beyond 6th year on H1. Now all you need is the latest I-94 and form I-907 along with I-140 original labor certificate to do premium processing.
Now there are no restriction, any one eligible to file I-140 can do premium.
Good luck
Raj:)

Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.
That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.
The fiscal year cap (numerical limitation on H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)) for FY 2011 is 65,000. Additionally, the first 20,000 H-1B petitions filed on behalf of individuals who have earned a U.S. masters degree or higher are exempt from the H-1B cap.
USCIS will monitor the number of petitions received and will notify the public of the date on which USCIS received the necessary number of petitions to meet the H-1B cap. If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date. USCIS will reject cap-subject petitions that are not selected, as well as those received after the final receipt date.
We recommend employers to hurry up and get all the necessary documents in order to meet the April 1, 2010 deadline.

If you really don't want to use the DataGrid, you could just use a ListBox. Each ListBoxItem (you can edit the ItemsTemplate) could be a textbox with a series of comboboxes inside it. That will give your users the illusion of having a scrolling list of items that they can enter values into.

Seek a competent lawyer's help. There is a "nunc pro tunc" option . Since you applied for the initial amendment in May 2009 after your expiration of OPT, they would have to check if any grace period applies or if it could be done in your case for "change of Status". But worth the try, in either case you make sure you are not "out of status".
Hope all ends well for you.

I am wondering about this because my I-485 has been filed in Texax Service Center and the receipting date is still way behind. I live in Minnesota and I need to ask my lawyer why did they file my application in TSC instead of NSC. Is there a choice about which Service Center to file applications in? Is there a possible rejection because my application could have been filed in NSC but is filed in TSC now?
Thanks in advance....

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.
Just my thought on this.

Anyone knows the background of this recapture? This is the first time I know congress had a law for it in 2000
Solution
The immediate solution is full accountability of all pending applicants for employment based immigrant visas both at USCIS and DOS. Without accurate data, it is difficult to hold the agencies accountable for their actions or inactions.
Another solution is to recapture lost visas. Between 1994 and 2006, USCIS underutilized the visa numbers by approving less than the 140,000 employment based applications each year even though USCIS had more than enough applications pending. Due to the statutory calculation method (explained more fully by USCIS and DOS on their websites), USCISs failure to timely process a sufficient number of applications resulted in the loss of approximately 349,000 visa numbers that could not be used in future years since the law prevents usage in future years. In 2000, Congress authorized the use of 130,000 these lost visa numbers by what has come to be known as the visa recapture method. However, approximately 219,000 numbers have not been recaptured. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. A one‐time recapture of the 219,000 unused visa numbers could go a long way to eliminating this backlog and bringing much needed relief to many applicants who currently face the prospect of becoming residents of the United States after they retire.

Bob is right. Don't buy anything from any camera shop in Brooklyn. Those package deals are not deals at all. They are a huge scam designed to steal your hard earned $ and leave you so frustrated at their total lack of customer service that you give up. If the price of any equipment is considerably less than B&H, Amazon, Adorama, or J&R, stay away. The stuff you'll get in that package will not be what you think it is. Anytime you want to know about the reputation of a place, check out this website:

Before I knew about these things, I got taken for a ride. It was so bad that I involved the good folks from Visa. Their lawyer delt with them and I did get my $ back. But it took a year before the case was resolved. So listen to Bob. Bob is right.
